The agreement between you and WellMensRX.
A legally binding contract that governs your use of our telehealth platform. Read it in full before you use the service. The sections on arbitration, limitation of liability, and refunds are particularly important.
Acceptance of these terms.
These Terms of Service (the "Terms") are a legally binding agreement between you ("you," "your," or "User") and WellMensRX ("WellMensRX," "we," "us," or "our"). They govern your access to and use of our website, mobile applications, telehealth platform, and related services (together, the "Services").
By clicking "I Agree," checking a box, creating an account, or otherwise accessing or using our Services, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
This is a click-wrap agreement. Your affirmative action creates a binding contract. Continued use constitutes ongoing acceptance, including of any future modifications.
1.1 HIPAA acknowledgment
By using our Services, you acknowledge that we handle Protected Health Information (PHI) in accordance with HIPAA and our Notice of Privacy Practices, and you consent to the collection, use, and disclosure of your health information as described in our Privacy Policy.
Dispute resolution and binding arbitration.
2.1 Agreement to arbitrate
You and WellMensRX agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services (each, a "Dispute") will be settled by binding arbitration. Each party retains the right to seek injunctive or equitable relief in court to prevent infringement, misappropriation, or violation of copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
2.2 Class action waiver
You and WellMensRX agree that each party may bring Disputes only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Unless both parties agree otherwise in writing, the arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
2.3 Arbitration procedures
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in English. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
2.4 Opt-out right
You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these Terms. Your opt-out notice must include your name, address, email, and a clear statement that you wish to opt out. Send to support@wellmensrx.com.
2.5 Small claims exception
Either party may bring a claim in small claims court if the claim qualifies for small claims jurisdiction.
Medical emergency disclaimer.
WellMensRX is not an emergency medical service. If you are experiencing a medical emergency, call 911 immediately or go to your nearest emergency room.
Our platform is designed for non-urgent evaluation and treatment of men's health conditions. Seek emergency care immediately for:
- Chest pain or pressure
- Difficulty breathing or shortness of breath
- Severe allergic reaction
- Loss of consciousness
- Severe bleeding
- Priapism (erection lasting more than 4 hours)
- Sudden vision or hearing loss
- Signs of stroke or heart attack
Do not use our messaging, telehealth platform, or customer support for emergency situations. Our providers are not available 24/7 and cannot provide emergency care.
What we do and don't do.
WellMensRX operates a telehealth platform that connects patients with licensed U.S. healthcare providers for evaluation, diagnosis, and treatment of men's sexual health conditions including erectile dysfunction, premature ejaculation, and related concerns.
4.1 Services include
- Online medical questionnaires and health assessments
- Asynchronous telehealth consultations with licensed physicians
- Prescriptions for FDA-approved and compounded medications when medically appropriate
- Coordination with licensed pharmacies for fulfillment
- Ongoing care coordination and refill management
- Educational resources and treatment information
4.2 Platform role
WellMensRX is a technology platform that facilitates the connection between patients and providers. We do not practice medicine, provide medical advice, or prescribe medications. All medical services are delivered by independent licensed healthcare professionals.
4.3 State availability
Not all services are available in every state. Availability depends on your state of residence, medical history, and provider licensure. In states including Alaska, Louisiana, Mississippi, New Hampshire, New Mexico, and North Dakota, state law may require a live video consultation or impose additional requirements in order to prescribe. We serve patients in those states, but a video consult or additional step may be needed before a provider can treat you.
Who may use the Services.
To use our Services, you must:
- Be at least 18 years of age
- Be located in a U.S. state where our services are available
- Provide accurate, complete, and current information
- Be medically appropriate for telehealth services
- Have the legal capacity to enter into a binding contract
We reserve the right to verify your eligibility and to refuse service to anyone who does not meet these requirements. Our Services are not intended for minors.
Account registration and security.
To access certain features, you must create an account. You agree to:
- Provide accurate, complete, and current information
- Maintain and promptly update your account information
- Keep your credentials secure and confidential
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities under your account
- Not share your credentials with any third party or create accounts using false information
You are solely responsible for maintaining the confidentiality of your account credentials. We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in fraudulent or illegal activity.
Telehealth services.
By using our telehealth services, you acknowledge and agree to the following. For the full consent document, see Telehealth Consent.
7.1 Nature and limitations
Telehealth involves delivery of healthcare through electronic communications. Providers cannot perform physical examinations or in-person diagnostic tests. Assessment depends on the accuracy and completeness of the information you provide. Technology failures may interrupt consultations. Telehealth may not be appropriate for all conditions.
7.2 Your responsibilities
You agree to provide accurate and complete medical information, follow your provider's instructions, report any adverse reactions, and maintain regular in-person care with a primary care physician.
7.3 Provider discretion
Providers have sole discretion to determine whether telehealth is appropriate and whether to prescribe treatment. A provider may decline to prescribe, recommend in-person evaluation, or require additional information.
7.4 No guarantee of treatment
Receiving a consultation does not guarantee that you will receive a prescription or any specific treatment. Treatment decisions are made independently by licensed healthcare providers based on their medical judgment.
Independent medical professionals.
All healthcare providers who deliver services through the WellMensRX platform are independent professionals, not employees or agents of WellMensRX. Providers include physicians, nurse practitioners, and other licensed professionals practicing through independent medical groups or professional corporations.
Providers are solely responsible for all medical decisions, including diagnosis, treatment recommendations, and prescribing. Providers maintain their own professional liability insurance and are subject to state medical board regulation.
No physician-patient relationship exists between you and WellMensRX itself. Your physician-patient relationship is with the individual provider who evaluates and treats you.
Prescription medications.
Prescriptions may be issued by licensed healthcare providers following a medical evaluation. By requesting prescription services, you acknowledge:
- Medical evaluation required: all prescriptions require review by a licensed provider of your medical history, current medications, and health status.
- Types of medications: providers may prescribe brand-name, generic, or compounded medications based on their medical judgment.
- Risks and side effects: all medications carry risks. You are responsible for reading medication information, following dosage instructions, and reporting adverse reactions to your provider.
- Drug interactions: you must inform your provider of all medications, supplements, and herbal products you take. Failure to disclose may result in dangerous interactions.
- Contraindications: you must disclose your complete medical history, including heart disease, blood-pressure issues, liver or kidney problems, and use of nitrate medications.
- Off-label use: some medications may be prescribed off-label; your provider will discuss risks and benefits.
- Controlled substances: in compliance with DEA regulations and state law, our providers do not prescribe controlled substances (Schedule I–V) through telehealth.
Compounded medications.
Compounded medications are not FDA-approved. The FDA does not verify the safety, effectiveness, or quality of compounded drugs.
10.1 What they are
Compounded medications are customized pharmaceutical preparations made by state-licensed compounding pharmacies (503A) or federally registered outsourcing facilities (503B) to meet specific patient needs. Compounding involves combining, mixing, or altering ingredients to create a medication tailored to individual requirements.
10.2 How they differ from FDA-approved drugs
Unlike FDA-approved brand-name or generic drugs, compounded medications have not undergone FDA premarket review for safety, effectiveness, or quality. They are not standardized and may vary in composition, strength, and formulation.
10.3 Compounding standards
Compounded medications provided through WellMensRX are prepared by state-licensed compounding pharmacies under Section 503A or federally registered outsourcing facilities under Section 503B of the Federal Food, Drug, and Cosmetic Act. Pharmacies follow USP compounding standards.
10.4 Risks
Compounded medications may carry additional risks compared to FDA-approved drugs, including variations in potency, quality, purity, and stability. By accepting a compounded medication, you acknowledge these risks and accept responsibility for your decision to use a non-FDA-approved medication.
10.5 Your right to choose
You have the right to request FDA-approved alternatives when available. Your provider will discuss the options.
Pharmacy services.
Prescriptions are dispensed by licensed pharmacies that partner with WellMensRX. These pharmacies are independent entities, not owned or operated by us. All partner pharmacies are licensed and in good standing with their state boards.
The dispensing pharmacy is responsible for filling your prescription accurately, providing medication counseling, verifying drug interactions, and complying with pharmacy laws. When you receive your medication, you should verify it matches your prescription, check the expiration date, and read all labels. Contact the pharmacy immediately if you notice any discrepancies.
Dispensed medications cannot be returned once successfully dispensed and shipped, in compliance with federal FDA regulations. If you believe there has been a pharmacy error or you received a defective product, contact us within 7 days of delivery.
Payment, pricing, and billing.
Free consultation
The online medical consultation is free for approved and completed orders. Your card is only temporarily authorized. If our medical team does not approve your prescription, the hold is instantly released. A $40 minimum consultation fee applies to declined or incomplete orders.
12.1 Fees and charges
You agree to pay all fees associated with approved Services, including medication costs, shipping, and applicable taxes. All fees are disclosed before checkout. Payment is only collected after prescription approval (except for the minimum consultation fee on declined or incomplete orders).
12.2 Payment methods
We accept major credit and debit cards and other payment methods as indicated on our platform. By providing payment information, you authorize us to charge your payment method for all fees incurred after your prescription is approved.
12.3 Subscriptions
Some Services are offered on a subscription basis with recurring charges. By enrolling, you authorize us to charge your payment method automatically at regular intervals until you cancel. You may cancel at any time through your account or by contacting support.
12.4 Price changes
We may change pricing at any time. Price changes will not affect orders already placed, but will apply to future orders. We will notify subscription users of material price changes before they take effect.
12.5 Billing disputes
Contact us within 60 days of a charge if you believe you have been incorrectly billed. Email support@wellmensrx.com with "Billing" in the subject line.
12.6 Insurance
Our Services are generally not covered by insurance. We do not bill insurance and do not accept insurance payments. You are responsible for full payment at the time of service.
12.7 Failed payments
If a payment fails or is declined, we may suspend access to Services until payment is received. You remain responsible for any unpaid amounts.
Shipping and delivery.
Medications ship via USPS, UPS, FedEx, or other carriers in discreet, unmarked packaging. Standard shipping typically takes 3–7 business days. Expedited options may be available for an additional fee.
You must provide an accurate and complete shipping address. We are not responsible for delays or non-delivery from incorrect address information. Some medications may require signature on delivery — you are responsible for ensuring someone is available to receive the package.
We do not ship outside the United States. Once a package is delivered by the carrier, we are not responsible for lost or stolen packages; contact the carrier to file a claim. We are not responsible for shipping delays caused by weather, carrier issues, or other events beyond our control.
Refund policy.
We stand behind the medications we dispense. The refund policy below reflects our real-world practice: we refund situations where we made an error, and we refund unopened portions when a formula is not working for you. We do not offer a blanket satisfaction guarantee, and prescription medications are subject to FDA regulations that restrict what can be returned.
14.1 When you get a full refund
- Prescription not approved. If our medical team declines your request, any hold on your card is released. You pay nothing for the consultation when the decline or incomplete result is resolved promptly. (A $40 minimum consultation fee applies to declined or incomplete orders that do not proceed.)
- WellMensRX or pharmacy error. Wrong medication, wrong dosage, damaged in transit, or failed to ship when it should have. Contact us within 7 days of delivery with photos and order details. We will arrange a replacement or refund at no cost to you.
- Pre-shipment cancellation. If you cancel before your prescription ships, we refund you in full.
- Billing errors or duplicate charges. Refunded in full once verified.
14.2 Partial refund — formula not working
If a formula is not working for you, we will refund the unopened portion of your current shipment once returned. This is offered at our discretion on a case-by-case basis. Contact support with your order number and a brief explanation. This is not a satisfaction-or-your-money-back guarantee — it is a fairness policy for patients whose treatment is not producing the response they expected.
14.3 Non-refundable
- Opened or partially used prescription medications
- Compounded medications that have already been prepared specifically for you
- Subscription billing periods during which medication was already dispensed
- Change of mind after a shipment has been prepared and sent
Federal regulations and pharmacy law prohibit the return of prescription medications once dispensed. This is a safety measure to protect the integrity of the pharmaceutical supply chain.
14.4 Subscription cancellation
You can cancel your subscription at any time through your account or by emailing support. Cancellations take effect at the end of your current billing period. No cancellation fee. No refunds for periods where medication was already dispensed.
14.5 How to request a refund
Email support@wellmensrx.com with subject "Refund Request — [Order Number]". Include your full name, account email, order number, reason for the request, and any supporting documentation (photos for damaged items). Our team responds within 24–48 business hours.
14.6 Refund timeline
Once approved, refunds are processed to your original payment method within 5–7 business days. Your bank may take an additional 3–5 days to post the credit.
14.7 Chargebacks
Before initiating a chargeback with your bank, contact us so we can resolve the issue. Chargebacks filed without first contacting us, or chargebacks determined to be fraudulent, may result in account termination and collection of the disputed amount plus fees. We dispute illegitimate chargebacks and maintain detailed records of all transactions.
14.8 Fraud and abuse
We reserve the right, in our sole discretion, to deny refunds or cancel accounts for patterns of repeated refund requests, suspected fraud, violation of these Terms, or providing false information during consultation.
Ownership, trademarks, and license.
All content on the WellMensRX platform — text, graphics, logos, images, video, software, design — is owned by WellMensRX or our licensors and is protected by copyright, trademark, and other intellectual-property laws.
WellMensRX, Epiq Scripts, and all related logos and marks are trademarks of WellMensRX. You may not use these without our prior written permission.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services, reverse engineer our software, or use automated systems (bots, scrapers) to access the Services.
You retain ownership of content you submit (such as medical information or communications). By submitting content, you grant us a license to use, store, and process that content to provide the Services.
If you believe your copyright has been infringed, contact support@wellmensrx.com with details of the alleged infringement.
Limitation of liability.
To the maximum extent permitted by law, WellMensRX and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Services
- Any unauthorized access to or use of our servers or your personal information
- Any interruption or cessation of transmission to or from our Services
- Any bugs, viruses, or other harmful code transmitted through our Services
- Any errors or omissions in content
- The conduct or content of any third party on the Services
- Medical decisions made by independent healthcare providers
- Adverse reactions to medications prescribed by healthcare providers
In no event shall WellMensRX's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to WellMensRX in the twelve (12) months preceding the event giving rise to liability, or one hundred dollars ($100), whichever is less.
16.1 Services provided "as is"
Our Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
16.2 No medical guarantees
We do not guarantee any specific medical outcomes, results, or treatment effectiveness. Medical decisions and outcomes are the responsibility of independent healthcare providers and the individual patient's circumstances.
In jurisdictions where these limitations are restricted by law, our liability shall not exceed the greater of (a) the amount you paid to WellMensRX in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100 USD).
Indemnification.
You agree to indemnify, defend, and hold harmless WellMensRX, Epiq Scripts, and our affiliates, officers, directors, employees, agents, licensors, and service providers from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any law, regulation, or third-party right
- Your provision of false, inaccurate, or misleading information
- Your failure to disclose relevant medical information to providers
- Your use of medications in a manner inconsistent with prescribing instructions
- Any content or information you submit
- Your negligent or wrongful conduct
This obligation survives termination of these Terms. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
Governing law and jurisdiction.
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law provisions. Subject to the arbitration provisions in Section 2, any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to personal jurisdiction in those courts.
To the extent permitted by law, you and WellMensRX waive any right to a jury trial in connection with any action arising out of these Terms or the Services. Healthcare services are subject to state-specific regulations, and your access to Services may be limited based on your state of residence and provider licensure.
Changes to these Terms.
We may modify or update these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page and may notify you through the Services, by email, or other reasonable means.
For material changes that significantly affect your rights or obligations, we will provide at least 30 days' notice before the changes take effect (unless we are legally required to implement sooner). Your continued use after changes take effect constitutes acceptance. If you do not agree to the modified Terms, you must stop using the Services.

General provisions.
20.1 Force majeure
We shall not be liable for any failure or delay in performing obligations due to circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, government action, supply-chain disruptions, carrier delays, or internet or telecommunications failures.
20.2 Severability
If any provision is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.
20.3 Entire agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and WellMensRX regarding your use of the platform and supersede all prior agreements, representations, and understandings.
20.4 Waiver
Our failure to enforce any right or provision is not a waiver. Any waiver must be in writing and signed by an authorized representative of WellMensRX.
20.5 Assignment
You may not assign or transfer these Terms or your rights without our prior written consent. We may assign without restriction, including in connection with a merger, acquisition, or sale of assets.
20.6 Survival
Limitation of Liability (§ 16), Indemnification (§ 17), Arbitration (§ 2), Intellectual Property (§ 15), and any other provisions that by their nature should survive termination, will survive.
20.7 Headings & third-party beneficiaries
Section headings are for convenience only. These Terms do not create any third-party beneficiary rights except as expressly provided.
